Since the new judge (Judge Guidi retired) already indicated at a brief hearing back in March (where Seller was requesting return of his $88,401.08 in cash-in-lieu-of-appeal-bond which earns no interest) that she favored the HOA (despite knowing nothing about the case) and denied Seller's refund request, this matter, which is already in its 6th year since HOA started it by filing a bogus foreclosure action on 8 Jan 2021) will almost certainly be back up in the Alaska Supreme Court by sometime in 2028 or 2029 for another smack-down. 27 Feb. 2026 update. HOA legal actions update against owner: Ralph Guditz v. Lakeside North Condominium Home Owners Association, Nationstar Mortgage, and Bank of America | S19267 | Alaska | Judgment | Law | CaseMine. It is not clear to what extent HOA's insurer State Farm, which has been funding HOA's legal action against the unit owner through attorney Megan Sandone of Jermain Dunnigan & Owens, P.C., will continue, since legal fees costs judgement in now in favor of unit owner being found not responsible for HOA legal fees. It could go on for yet another 5 years. Development Services, while it claims to lack jurisdiction over HOAs (e.g. with regard to building code, permits, etc.) maintains that it will issue "clearing out" orders for all 12 units upon the collapse of a single unit's roof". Condemnation.
